WATER RIGHT ADMINISTRATION

• Obtain new water rights

• Advise on changed water right uses

• Assess water right needs

• Identify water rights associated with particular real property

• Evaluate the legal status of water rights

• Assist with real estate transactions and transfers of water rights

• Represent clients in administrative proceedings before the Idaho Department of Water Resources

• Assist with the development of new water rights legislation

• Form and advise ground water districts and other water delivery organizations

• Assist with the purchase and sale of water rights

• Advise on water shortage and water delivery call issues

• Represent water users in district courts and appellate courts

WATER RIGHT ADJUDICATIONS

• File water rights claims in the Snake River Basin Adjudication (SRBA)

• Represent water users on basin-wide legal issues arising in the SRBA

• Litigate water right objections and conflicting water right claims

• Prosecute motions to file late objections and late claims

• Represent clients in water shortage and water conflict proceedings

• Work with the Idaho Department of Water Resources on behalf of clients who are claimants in the SRBA

ENVIRONMENTAL COMPLIANCE

• Advise on complex legal matters concerning water quality, hazardous waste regulation, site remediation, asbestos, PCBs, public (BLM and Forest Service) lands, species protection, transportation, and underground storage tanks

• Conduct environmental compliance audits

• Represent clients in EPA and State administrative proceedings

• Participate in and comment on administrative rule makings

• Advise on environmental permitting issues

• Assist with the development of new and amended environmental legislation

• Respond to enforcement inquiries and information requests

• Assist with preparation for enforcement inspections

ENVIRONMENTAL ISSUES IN REAL ESTATE TRANSACTIONS

• Conduct due diligence reviews of environmental compliance

• Advise on contamination and remediation issues

• Analyze environmental liability issues

• Prepare environmental liability provisions for transaction documentation

• Advise on site assessment issues

• Advise on land use and zoning matters

ENVIRONMENTAL LITIGATION

• Represent potentially responsible parties in site remediation and cost recovery actions

• Defend and resolve EPA and State enforcement actions

• Represent businesses in challenges to administrative policies and rules
